Terms of Service

These Terms of Service ("Terms") govern your use of services provided by TruePath Development LLC ("Company," "we," "us," or "our"), including website development, AI chat and voice assistant setup, lead capture systems, business automation, digital marketing support, CRM consulting, and related digital services. By engaging our services or using our website, you agree to these Terms.

1. Services

TruePath Development LLC provides custom digital services including, but not limited to:

  • Website development and landing page design
  • AI chat and voice assistant configuration and setup
  • Lead capture system setup, including forms, booking pages, and call tracking
  • Business automation, including CRM workflows, reminders, and email/text automations
  • Digital marketing support, including service pages, promotional assets, and local visibility work
  • CRM and workflow consulting
  • Related digital business services

The specific scope, deliverables, and timeline for any project will be described in a separate proposal, agreement, or statement of work provided to the client.

2. Payment Terms

Payment terms will be specified in your project agreement or invoice. Unless otherwise stated in writing:

  • Custom project payments may be non-refundable once work has started
  • A deposit or upfront payment may be required before project work begins
  • Invoices are due upon receipt unless a payment schedule has been agreed upon in writing
  • Late payments may result in a pause or termination of services

3. Ongoing Services

Ongoing services such as website hosting, maintenance, AI tools, software subscriptions, or support retainers may be billed separately from one-time project fees. These services will be described in a separate recurring service agreement and may be subject to their own cancellation terms.

4. Client Responsibilities

The client is responsible for:

  • Providing accurate business information, brand assets, images, and written content in a timely manner
  • Reviewing and approving work within agreed-upon timelines
  • Providing login credentials, platform access, or third-party tool access when required for project completion
  • Ensuring all information and materials provided to TruePath Development LLC are legally owned or licensed by the client
  • Responding to communications and approval requests in a timely fashion to avoid project delays

Delays caused by the client's failure to provide materials or approvals may result in adjusted project timelines and may affect pricing.

5. No Guarantee of Results

TruePath Development LLC does not guarantee specific revenue, lead volume, search engine rankings, advertising results, or other business outcomes. Digital services are provided on a best-efforts basis. Results depend on many factors outside our control, including market conditions, competition, the client's industry, and the client's own business operations.

6. Intellectual Property

Upon full payment for a completed project, the client will own the final deliverables (e.g., website files, copy, graphics) created specifically for them. TruePath Development LLC retains ownership of any proprietary tools, frameworks, templates, or methodologies used in the creation of deliverables.

Third-party software, platforms, or licensed assets incorporated into a project remain subject to their respective license agreements.

7. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the engagement, including business strategies, customer data, login credentials, and financial information. This obligation survives the termination of any service agreement.

8. Limitation of Liability

To the maximum extent permitted by applicable law, TruePath Development LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue or profits, arising out of or related to the services provided. Our total liability for any claim shall not exceed the total fees paid by the client for the specific service giving rise to the claim.

9. Service Brands

Missed Calls to Cash is a service brand operated by TruePath Development LLC. Services delivered under the Missed Calls to Cash brand are governed by these same Terms of Service unless a separate agreement specifies otherwise.

10. Termination

Either party may terminate an ongoing service agreement with written notice as specified in the applicable service agreement. Upon termination, the client is responsible for any fees owed for work completed up to the termination date. TruePath Development LLC reserves the right to suspend or terminate services for non-payment or material breach of these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Maryland. Any disputes arising under these Terms shall be resolved in the appropriate courts located in Howard County, Maryland.

12. Changes to These Terms

We may update these Terms of Service from time to time. When we do, we will revise the "Last Updated" date at the top of this page. Continued use of our services after any update constitutes acceptance of the revised Terms.
